Chapter 7 Bankruptcy
Chapter 7 bankruptcy is designed for debtors in financial difficulty who do not have the ability to pay their existing debts. Debtors whose debts are primarily consumer debts are subject to a “means test” designed to determine whether the case should be permitted to proceed under chapter 7. In filing a chapter 7 on your behalf, I am able to protect most, if not all, of your assets with exemptions set forth under the law.
Chapter 13 Bankruptcy
Chapter 13 bankruptcy is designed for individuals with regular income who would like to pay all or part of their debts in installments over a period of time. I file a plan with the court to repay the creditors all or part of the money you owe them, using your future earnings over a period between three to five years. Chapter 13 is generally for debtors who are:
– Behind on their mortgage payments and need a plan to catch up;
– Above the median income and not eligible for Chapter 7 under the “means test”
– In possession of real estate and/or personal property that has equity that substantially exceeds the allowable exemptions.
