Chapter 7 is a quicker process overall, resulting in a discharge of personal debts in exchange for the liquidation of all non-exempt assets.  In many instances, all the assets are exempt from collection, which means the petitioner would not lose anything to the trustee.  If the petitioner has a lot of non-exempt assets, the Chapter 7 trustee would likely take those items and sell them to distribute to the creditors.  In this situation, Chapter 13 may be a better option.

Chapter 13 involves a repayment plan between 3 to 5 years.  The Chapter 13 Trustee does not take any assets away, but can oppose the proposed plan if it does not pay enough money into the bankruptcy estate.  In many instances, a higher income or large amount of non-exempt assets leads to filing under this chapter.
