Medina County Divorce

Medina County divorce cases are handled a little differently, starting in 2024.  The Medina County Domestic Relations Court created new local rules that change the way divorce cases are handled.  This includes case management, temporary orders hearings, pretrials and final hearings.

Medina County Divorce Case Management Hearings

Case management hearings are initially set with the judge.  Once the judge learns some facts about the case, the judge decides whether the case will be heard by a judge or magistrate.  Additional hearing dates are set at this hearing or soon after the hearing.

Medina County Divorce Temporary Orders Hearings

Temporary orders hearings are heard by the magistrate assigned to the case. The magistrate listens to statements of the divorce attorneys and makes decisions regarding temporary support, child custody, and parenting time. 

Medina County Divorce Pretrial Hearings

The court sets one or more pretrial hearings. Pretrial hearings are opportunities to update the court on the progress of the case. If the parties are ready, they can settle the case.  Settling the case saves the parties from costly and time-consuming litigation.

Medina County Divorce Final Hearings

The final hearing is usually set between nine to twelve months from the date the divorce is filed.  If the parties cannot settle the case by this date, the final hearing will usually go forward.  At this hearing, the court will hear testimony and review exhibits.  After hearing the evidence, the court rules on the evidence. This ruling becomes the divorce decree. The divorce decree decides how to divide the assets and liabilities, as well as child custody, parenting time and support.
